Terms & Conditions

By entering into a photography agreement with meganayn photography, ​both parties agree to the following terms and conditions:

1. Scope of Services

• meganayn photography agrees to provide photography services for the Client as described below:

  • A mutually agreed upon session date, location and session type.

2. Payment Terms​

• A non-refundable deposit of $50 is required to secure the session date. The remaining balance is due on or before the session date.

3. Cancellation and Rescheduling

• Cancellation: If the Client cancels within 48 hours of the scheduled session, the deposit is forfeited.

• Rescheduling: In the event of inclement weather or other unforeseen circumstances, the session may be rescheduled at no additional charge. meganayn photography will work with the Client to find a mutually agreeable new date.

4. Delivery of Images

• Final images will be delivered via online gallery 2-3 weeks of the session date.

• meganayn photography retains the right to edit and select the final images delivered to the Client.

5. Use of Images

• The Client grants meganayn photography permission to use images from the session for promotional purposes, including but not limited to portfolio display, social media, advertising, and website galleries.

• If the Client does not wish for their images to be used, they must notify meganayn photography in writing before the session date.

6. Liability

• meganayn photography is not responsible for any injuries, accidents, or damages that occur during the session. meganayn photography is not liable for failure to provide images due to unforeseen circumstances beyond their control, such as equipment failure or extreme weather.

7. Client Responsibilities

• The Client agrees to arrive on time for the session and to provide accurate and complete information about their needs.

• The Client is responsible for ensuring all participants adhere to the session guidelines.

8. Non-Profit Event Discount Policy

• We are proud to support non-profit organizations and their efforts to make a positive impact in our community. To ensure fairness, the following criteria apply to qualify for our non-profit event discount:

  • Eligible Organizations

    • Must be a registered 501(c)(3) non-profit organization.

  • Eligible Events

    • The event must be organized directly by the non-profit.

    • Events must have a charitable, educational, or community-focused purpose. Examples include:

      • Fundraisers for charitable causes

      • Volunteer appreciation events

      • Educational workshops or community outreach programs

  • Ineligible Events

    • Events primarily for private or personal purposes (e.g., weddings, birthday parties, religious ceremonies).

    • For-profit events, even if hosted by a non-profit.

• Discount Request Process

  • Submit a request form at least 3 days before the event.

  • Include the following:

    • Proof of non-profit status

    • Event description and purpose

    • Contact information for verification

• Caveats:

  • Discounts are provided at our discretion and are subject to availability.

  • Misrepresentation of event details may result in disqualification from future discounts.

9. Senior Influencer Program:

• ​By participating in the Senior Influencer Program ("Program") with meganayn photography,  you ("Influencer") agree to the following terms and conditions:

  • Eligibility

    • Open to high school and college seniors graduating in the current academic year.

    • Must have active social media accounts.

    • Parental or guardian consent required for participants under 18.

  • Influencer Responsibilities

    • Participate in scheduled photo sessions.

    • Share a minimum of 2 posts per scheduled photo session featuring meganayn photography photos on personal social media platforms.

    • Tag meganayn photography's official social media accounts and use designated hashtags in all related posts.

    • Maintain a positive online presence.

  • Compensation and Benefits

    • Receive reduced rate photo sessions and a select number of free edited digital images.

    • Gain early access to seasonal photo shoots.

    • Earn referral credits for each new client referred which can be applied to photo keepsakes such as prints, albums and wall art.

    • Additional perks can be offered beyond those outlined above.

  • Content Usage Rights

    • Grant meganayn photography non-exclusive rights to use images and content created during the Program for promotional and marketing purposes.

    • Influencer retains personal use rights to the images provided.

  • Liability

    • meganayn photography is not responsible for any injuries, accidents, or damages that occur during photo sessions or as a result of participation in the Program.

  • Amendments

    • meganayn photography reserves the right to modify these terms and conditions at any time. Influencers will be notified of any changes.

    • By participating in the Program, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
